Privacy Policy on Personal Data Processing

• GENERAL PROVISIONS 

  1.1. This Policy defines the approach of LLP «Kazakhstan International Realty» (BIN 220640050372, hereinafter – the Company) to the collection, storage, use, and protection of personal data of individuals, including users of the website www.sothebys-realty.kz and other digital platforms managed by the Company.

  1.2. The Company is a personal data operator within the meaning of the Law of the Republic of Kazakhstan dated May 21, 2013 No. 94-V «On Personal Data and Their Protection» with amendments and additions (hereinafter – the Law) and processes personal data in accordance with the principles, purposes, and protection measures established by the current legislation of the Republic of Kazakhstan.

  1.3. Personal data processing is carried out in compliance with the principles of legality, fairness, minimization, and purpose limitation.

  1.4. By using our website or other services, you confirm your consent to the processing of your personal data in accordance with this Policy.

• LEGAL BASES FOR PROCESSING

  2.1. The Company processes personal data on at least one of the following grounds:

  • obtaining consent from the personal data subject (in written, electronic form, or by actions confirming the intent to interact);
  • performance of a contract or preparation for its conclusion;
  • fulfillment of obligations stipulated by the legislation of the Republic of Kazakhstan;
  • exercising the rights and legitimate interests of the Company, provided that the rights of the subject are not violated;
  • cross-border transfer is allowed only to:
  - countries that provide an adequate level of protection for the rights of subjects;
  - other countries – with the written consent of the subject (Art. 16 of the Law).

• RIGHTS OF THE PERSONAL DATA SUBJECT

  The subject has the right to:
  
  • information about the processing of their personal data;
  • access, correction, blocking, and destruction of data;
  • withdraw previously given consent;
  • restrict processing;
  • appeal against actions (inaction) of the Company to authorized bodies or court;
  • be informed about the consequences of refusing to provide data.
  
  The Company undertakes to respond to the subject's request within 15 business days.

• REQUESTS FROM PERSONAL DATA SUBJECTS

  4.1. A personal data subject may submit a request to the Company regarding:

  confirmation of the fact of personal data processing;

  clarification, blocking, or destruction of their personal data;

  withdrawal of previously given consent for processing;

  information about third parties who have accessed their data.

  4.2. Requests can be sent:

  4.3. A response will be provided within 15 business days from the date of receipt of the request.

• RIGHTS OF THE SUBJECT IN PERSONAL DATA PROCESSING

  5.1. A personal data subject has the right to:

  receive complete information about their personal data processed by the Company;

  request clarification, blocking, or destruction of their data in cases provided by law;

  withdraw previously given consent to the processing of personal data;

  restrict the processing of their data;

  require the cessation of data processing for marketing purposes;

  appeal against the Company's actions to authorized bodies or court.

  5.2. The Company undertakes to notify the subject of the actions taken in response to their request within the established timeframe.

• TERMINATION OF PERSONAL DATA PROCESSING

  6.1. The Company ceases personal data processing in the following cases:

  upon achieving the processing purposes or when the need for achieving them ceases;

  upon expiration of consent or its withdrawal;

  at the request of the personal data subject if there are no other legal grounds for processing;

  upon liquidation of the Company;

  at the request of an authorized body or by court decision.

  6.2. Personal data must be destroyed within 30 calendar days from the date of occurrence of the grounds for termination of processing, unless otherwise provided by contract, law, or agreement with the personal data subject.

• USE OF COOKIES

  7.1. We use cookies, some of which may be personal data if they allow user identification.

  7.2. Cookie settings can be changed by the user in the browser, but this may affect the website functionality.

• POLICY CHANGES

  8.1. The Company may make changes to the Policy. In case of significant changes, the subject will be notified via email and/or publication on the website.
